THE Law Commission are to recommend that the law be changed to make prenuptial agreements legally binding.

These agreements can protect couples who are planning to marry or enter into a civil partnership together and set out how assets will be divided if you split up at a later date.

If you are involved in a family business, you and your extended family may feel more comfortable with the protection of a pre-nup as a divorce can have an enormous impact on your fellow shareholders and employees.

In the event of a divorce, if there is no pre-nup in place, the private financial matters of the family will be exposed, shares will be valued, your interest could be at risk and you may need to raise money through the business to meet financial claims.

The upset of an acrimonious divorce can generate upheaval within the business and concern that shares will not be kept within the family and this can be minimised with a prenuptial agreement.
