A DEVELOPER has been taken to court by the county council for allegedly failing to reinstate a street after carrying out work in a village on the outskirts of Taunton.

The charges against St Modwen Homes Ltd were mentioned in Taunton Magistrates' Court on Wednesday (July 5).

The company, based at Two Devon Way, Longbridge, Birmingham, faces four counts.

It is firstly accused of failing to comply with the Street Works (Reinstatement) Regulations at Great Western Way, Norton Fitzwarren, on or about March 26, 2021

St Modwen is said to have not adhered to the specification of materials to be used; the standard of workmanship to be observed; and performance standards by not reinstating the white lines of the carriageway or the footpath and not reinstating the cycleway's red tarmac surface.

Secondly, it is claimed the company failed to respond to defect notifications issued by the council relating to street works at Great Western Way between January 10 and March 3 last year. The court heard St Modwen "failed to use its best endeavours to cooperate with the street authority and other undertakers in the interests of safety, to minimise the inconvenience of persons using the street (having regard in particular to the needs of people with a disability), and to protect the structure of the street and the integrity of apparatus in it".

The third alleged offence between March 2021 and April this year states that the company failed to complete the permanent reinstatement at Great Western Way within six months of March 26 2021.

The final count says St Modwen failed between March 26 2021 and April 5 this year to reinstate the street after executing works at Great Western Way.

The case was adjourned until September 27 at the same court.
