THE next appeal lodged by Gladman Land Ltd is set to set start - but will it have the same outcome?

After Taunton Deane Borough Council backed down on its legal arguments on a similar appeal for Bagley Road in Rockwell Green, Gladman will once again face the authority's legal team in a dispute, this time over 130 houses off North Street, Wiveliscombe.

TDBC refused the application in March earlier this year, stating the site was 'outside of the defined settlement limit of Wiveliscombe' and fears there was a lack of affordable housing provision.

Gladman Land continues to argue that Taunton Deane cannot meet its five-year housing land supply.

A spokesman said: "We will demonstrate the site's location outside of the settlement boundary for Wiveliscombe does not make the site inherently unsustainable.

"We will show that the council cannot deomstrate a five-year housing land supply, and therefore sustainable development sites are required to meet this existing deficiency.

"Overall we will establish there are no significant and demonstrable harms from the development which would outweigh the benefits of the proposal."

The appeal will start on Tuesday, July 31, at 10am at the Albemarle Centre in Taunton. The appeal is expected to last eight days.
